The doctor's diagnosis and treatment plan is also key in determining compensation sufficient to cover the cost of that treatment.

Investigation

The law firm will need to have specialized investigators research the potential sources of the asbestos exposure. The investigators will also research the exposure sites and products, the manufacturers, the distributors and sellers of the asbestoses materials and products responsible for the exposure to asbestos.

The Filing Of The Law Suit

The attorney will then be in a position to file a suit and a claim for damages against the parties responsible for the client's exposure to asbestoses.

Client's Deposition

Mesothelioma is a cancerous disease that is becoming more and more common. Affecting the mesothelial cells that make up the mesothelium – the outer lining that protects the body’s major organs such as the heart, stomach and lungs – this form of cancer is a direct result of regular and unprotected exposure to asbestos. The symptoms and the latency period of this disease mean that it is difficult to diagnose. Treatment for mesothelioma is still being investigated through clinical trials and research, but as a rule it responds poorly to the treatments that are currently used.

The people most at risk from being carriers of this cancer are those have worked with asbestos over the past thirty to fifty years. Because of this, the disease is most common in men between the ages of sixty and seventy as this is the group that commonly worked with asbestos during those years. Because of the lack of protection and regulations in those days, these workers were constantly exposed to the dust and fibres from the asbestos, which caused the cells of the mesothelium to become abnormal. However, because the disease takes decades to develop fully and manifest, many of them were oblivious to this until thirty to fifty years later. It is these men who are now lodging multi-million dollar lawsuits against the unscrupulous companies that exposed them to the dangers of asbestos, even though they were aware that it could cause harm to the employees.

There are also other people at risk from the disease; namely those who have had regular contact with a person who has worked with asbestos. Because these workers regularly carried dust and fibres on their clothes, skin and in their hair, they fibres and dust could be ingested by family members, who were then at risk of developing mesothelioma, respiratory problems or another asbestos related disease.

The organs most affected by mesothelioma are the lungs and the surrounding tissue. Pleural mesothelioma, which is the type affecting the lining of the lungs, is the most common variation of this cancer with symptoms which include breathing and swallowing difficulties, coughing, shortness of breath, fever and weight loss. The abdomen is another area affected by this cancer, and this variation is known as peritoneal mesothelioma. This type of mesothelioma is not as common as pleural mesothelioma. Symptoms of peritonealmesothelioma can include nausea and vomiting, weight loss and loss of appetite, fever, bowel obstruction and pain or swelling of the stomach area. The last variation of the cancer is pericardial mesothelioma, which is where the cancer affects the heart and the tissue surrounding it. This variation is a rare one, and symptoms can include palpitations, breathing difficulties, and persistent coughing.

The symptoms of mesothelioma are very common to a number of other diseases which are more well-known in society. Therefore, it is not unusual for the patient to be misdiagnosed when he or she goes in displaying any or all of these symptoms. People who have worked with asbestos should always let their doctor know this so that the doctor is more aware and more conscious of the possibilities in the event that the symptoms do manifest. A speedy diagnosis is important to the effective treatment of mesothelioma, and without being aware of the facts your doctor may not be able to make the diagnosis as quickly as he would if he is aware of the situation.

Although there are treatments for mesothelioma, they do not have a high success rate particularly on patients in whom the cancer is in its later stages. The faster the mesothelioma is diagnosed and treated, the more chance of success, which is why it is important to get as fast a diagnosis as possible.

Current treatments for mesothelioma include surgery, radiation therapy, palliative therapy and chemotherapy. The National Institute of Cancer along with a variety of other organizations and sponsors are currently conducting research intomesothelioma and carrying out clinical trials to try and find a treatment that will not only be more effective but will enable the successful treatment of the disease even in its later stages.

Mesothelioma is a disease that is still very hard to recognise, difficult to diagnose and virtually impossible to treat effectively. It is known that the disease is asbestos related and that there is a long latency period before symptoms become apparent. But with more and more cases coming to light each year, it is vital that further research is carried out in order to make this fatal disease more manageable for both patients and doctors.

Many organizations are involved in research in to mesothelioma. This includes the companies that are responsible for the use of asbestos. Many people that have been diagnosed with mesothelioma have now discovered that they can claim compensation for being exposed to hazardous asbestos by companies, which means that these companies have a responsibility to help with this research.

The National Institute of Cancer is also working hard to research mesothelioma, its symptoms, diagnosis and treatment. The rising number of mesothelioma cases means that it is essential to learn more about this disease in order to look into developing treatments.

With many mesothelioma patients now seeking legal advice, it has become essential for law firms to learn about and research the disease. It is the lawyer’s job to assist the mesothelioma patient and provide advice and resources from which the patient can get help and assistance. Therefore, law firms dealing with these types of cases also have a responsibility to learn about the disease and what can be done to help patients.

A great deal of research into mesothelioma goes into learning about the effects of asbestos upon cells, and how the cells are changed by exposure to this material. By learning how healthy cells and corrupted by asbestos, we hope to learn more about how this cell corruption can be prevented or minimised.

The National Institute of Cancer has also carried out clinical trials into the treatment of mesothelioma. The trials, which are performed with real patients who have been diagnosed with mesothelioma, should help to determine how effective the various treatments are, and hopefully will go some way to helping experts find more effective treatments for the disease.

Mesothelioma trials are based upon treatments that are thought to have some value to patients. But the trials are just that – trials. This means that there are no guarantees and that a great deal more work and research will be required before a conclusive and effective treatment is found. On the upside, many new trials are being carried out on a regular basis, and with the information and technology available to scientists today, the discovery of an effective treatment for mesothelioma patients is just a matter of time.

Medical professionals worldwide are currently involved in clinical trials, and each trial depends upon the extent of spread of the disease. Some trials are performed on those who have been diagnosed reasonably early, others on patients who were not diagnosed until the latter stages of the disease. It is important for scientists to find a treatment that is effective not only on those who are diagnosed early, but on all patients that suffer from this killer disease.

The research carried out into mesothelioma will hopefully mean that future generations of suffers can be saved, even if they are diagnosed with the disease. The research carried out is extremely costly, and is often sponsored by associated companies such as drug companies and research groups as well as by the government. Research into the contraction of the disease, and its subsequent development will ultimately enable professionals to devise the most effective treatment.

Several new methods of treatment have been used following research into mesothelioma. These include:

Photodynamic therapy, which uses fixed frequency light to target abnormal cells and kill them off by the activation of photosensitizing drugs.
Immunotherapy, which fights the abnormal cells through the use of the body’s own defence system through enhancement and development of the immune system.
Intensity Modulated Radiation Therapy, which is a radiation treatment that targets just the affected area/tumour, thus avoiding contact with healthy cells and tissue.
Although there is no quick-fix answer to the treatment of mesothelioma, ongoing research and dedication from the medical profession means that the chances of finding an effective treatment are continually increasing.

Mesothelioma is a cancer of the smooth lining of the chest, lungs, heart, and abdomen. This skin layer is made up of mesothelial cells, hence the name mesothelioma. Mesothelioma is a diffuse but solid tumor that begins as a result of insult to the tissues caused by asbestos particles. These have penetrated into the pleural cavity of the chest or into the abdomen. Mesothelioma is either called pleural mesothelioma or peritoneal mesothelioma based on where it appears.

Because it occurs in such a small number of patients mesothelioma is often referred to as an orphan disease. Numbers of newly affected individuals in the United States have been reported to be between 2,500 and 3,000 every year. A steady rise in cases is reported in North America, Europe, Australia, and Asia.

In its early stages mesothelioma is difficult to detect as it may start with a thickening of the pleural rind, or fluid which can be associated with many other conditions. This rind is normally thin and smooth in the non diseased state. In time it begins to demonstrate progression forming a more pronounced irregular rind and nodules which coalesce into a crust that compresses and invades into adjacent structures compromising lung and cardiac function. In the abdominal cavity it can invade into the liver and bowel rendering the patient inoperable. Peritoneal mesothelioma it is often found coating the omentum described sometimes as a salt like sand like particles too numerous to count and impossible to remove without sacrificing the entire omentum. Involvement of the ovaries and fallopian tubes is not uncommon in women and often mesothelioma is confused with ovarian cancer. Once vital organs are involved or disease identified outside of the operative field surgery is no longer an option and patients are referred to chemotherapy or clinical trials.

For the vast majority of patients, as the tumor mass grows, once subtle symptoms will give way to weight loss, cough, respiratory infections, fatigue, shortness of breath, digestive and bowel problems and pain in the chest or abdomen, depending upon whether it is pleural or peritoneal. It may begin to weep fluid into the intracavitary space. In the chest cavity this is called an effusion and it fills the space where the lobes of the lung reside, next to the lining of the chest cavity, and often spreads into the area surrounding the heart creating symptoms similar to those observed in congestive heart failure. In peritoneal patients it is called ascites and it fills the abdomen bathing the visceral organs with this malignant fluid.

The symptoms gradually become more noticeable prompting the patient to seek a medical consultation. By this time the progression of the disease may already be too advanced as the tumor may have spread to the lymph nodes and/or begun to metastasize to remote organs of the body like the brain, spleen, liver or kidneys. Metastatic mesothelioma is considered late stage and incurable, given the current state of treatments. It is widely reported that only 10-20% of patients with pleural mesothelioma are diagnosed early enough for surgical intervention, the rest are referred on to palliative care No such figures have been reported in peritoneal mesothelioma.

The compensation from mesothelioma lawsuits runs the gamut from small amounts to very sizeable sums in the millions of dollars, but every case is different from the next, and it's often difficult to predict what compensation might entail and whether or not the plaintiff will even receive a settlement verdict in their favor. However, an experienced asbestos attorney is well-equipped to decide whether your case is viable and likely to be awarded compensation.

This means that people who were exposed to asbestos through their own remodeling of their homes or their own work on their personal automobiles would not be able to file a workers compensation case for this exposure, but would instead be able to file an asbestos personal injury lawsuit. Remember, though, that a person who was exposed to asbestos on the job may file both an asbestos workers compensation case and an asbestos personal injury lawsuit.

They will explain the terms to you carefully, and if you decide together that it is acceptable, you will sign the appropriate papers and the case will be closed. At this point, you will not go to trial and cannot sue the defendants again. In the case of multiple defendants, some may offer a settlement while others may choose to go to trial.

As cases of mesothelioma increase, more and more claims and lawsuits are filed against the companies responsible for asbestos exposure. Consequently, there are now a large number of lawyers available that deal with mesothelioma lawsuits, sometimes on an exclusive basis. The amount of compensation varies from case to case, but the job of mesothelioma lawyers is to make these negligent companies pay their victims for the pain and suffering of this usually fatal disease.
Many people are unsure about how to file a claim for compensation. The process is relatively simple but you must act quickly in order to be eligible to claim. Most states set a time limit of one to two years for mesothelioma claims, and it is important to file your lawsuit within those time limitations in order to optimise your chances of getting compensation from these companies.

In many cases, what has arisen from these bankruptcy cases is the formation of mesothelioma compensation funds - sometimes referred to as trust funds. These are formed when the court orders these companies to set up funds for asbestos victims to be compensated.

A diagnosis of mesothelioma can be hard to accept for any individual, no matter how much a person may have mentally prepared for the possibility of having the disease. Indeed, many who develop mesothelioma know they were exposed to asbestos during their career and the possibility of developing this type of cancer often lingers in the back of their mind.
The lawyers at Clapper, Patti, Schweizer & Mason will not sit by and let corporations relieve themselves of liability by entering into transactions that muddy the water so bad a normal person would be at a loss to determine where those liabilities were transferred to. We take pride in the fact that we have successfully brought to light corporate liabilities asbestos defendants have attempted to hide from the public.
In addition to experienced doctors, there is one more individual that a mesothelioma patient should consider meeting - a reputable and knowledgeable attorney who is well-versed in asbestos and mesothelioma cases.

The government of Italy completely banned the use of asbestos. France followed in 1997, and with more than 3,000 reported deaths per year, Australia finally banned the use of asbestos in 2003. Japan banned the use of asbestos in 2004, and Britain introduced a series of strict regulatory laws in 2006, but asbestos is still not banned. Canada and Russia still provide the majority of the world's asbestos, and the top importers are third world nations with no regulatory laws to protect worker health.
Congress failed to pass the Fairness in Asbestos Injury Resolution Act of 2005, which would have created a trust for victims of mesothelioma to the tune of $140 billion. The idea was for the government to pay victims as a means of calming the massive tort and litigation. The bill was amended in 2006 to award victims $1.1 million upon diagnosis, but it again failed to pass in Congress.
Two New York men were awarded a combined $9 million in settlement by a New York jury as a result of them both contracting mesothelioma after work-related asbestos exposure. While their case was combined, they worked for separate companies , one an electrician since his teenage years and the other a pipe fitter but suffered the same negligence. They and their wives were awarded the settlement for pain and suffering and lost wages, among others.

A Los Angeles woman, Rhoda Evans, was awarded a settlement of $208.8 million after a jury declared that she was the victim of negligent exposure to asbestos after shed contracted the disease from washing her husband's clothes. He worked for the Los Angeles County Department of Water and Power and was regularly exposed to the mineral and its fibers because the company that provided the county's pipes did not disclose that they contained asbestos

Each year, thousands of people pass away or become ill due to the negligence of asbestos manufacturers and the development of asbestos-related disease. If you or a loved one has been diagnosed with an illness related to asbestos such as mesothelioma, speaking with a mesothelioma lawyer can help you understand if you have legal options for compensation.
Mesothelioma, which is almost exclusively caused by asbestos exposure, and other asbestos-related illnesses are attributed to negligence because companies that manufactured asbestos-containing products knew about the health risks of asbestos exposure, but decided not to tell employees or leak this information to the general public. Those diagnosed with mesothelioma have legal options and may seek compensation through the help of a mesothelioma lawyer. A mesothelioma lawyer can review additional expenses that could be covered under each claim, as each case varies. It is important to save all medical and financial records relating to asbestos-induced illness for this purpose.

It is often the case that individuals diagnosed with mesothelioma or other asbestos related lung disease were actually exposed many years in the past from products or activities of corporations that have long since disappeared. Some have entered into bankruptcy and set up trusts for their asbestos related liabilities while others have merely been consumed by other corporations in transactions that are not only confusing, obscure but sometimes downright impossible to comprehend.

By the 1930s and '40s, medical evidence had clearly linked asbestos exposure to lung disease and deadly asbestos cancers. Although asbestos companies were warned of these dangers, many chose not to use alternative substances in order to keep their profits high. Mesothelioma litigation exists because of these unethical actions and asbestos manufacturers are held liable for the undue suffering of those coping with asbestos-related disease.
If you have a history of asbestos exposure and have been diagnosed with mesothelioma, we strongly suggest you work with a firm that only handles asbestos litigation and are experts in getting you help as quickly and painlessly as possible. We work tirelessly to shine light on those responsible in our efforts to reach just compensation for your injuries.

It general takes between 15 and 50 years from exposure to asbestos before mesothelioma develops.mesothelioma takes a long time to incubate within a human body before symptoms may appear and cause suffering to the carrier.Tissue is removed, placed under the microscope, and a pathologist makes a definitive diagnosis and issues a pathology report. his presents a very difficult challenge for doctors and the medical community in diagnosing the disease and in many cases patients with this disease are either not aware that they have it or do not ask the doctor to specifically check for symptoms.

Needle Biopsy
The doctor may look inside the chest cavity with a special instrument called a thoracoscope. A cut will be made through the chest wall and the thoracoscope will be put into the chest between two ribs. This test is usually done in a hospital using a local anesthetic or painkiller.

X-Rays
Xrays can sometimes be used to diagnose Pleural Mesothelioma. If cancer is present it will appear as a mass covering the surface of the pleural mesothelium.

Peritoneoscopy
The doctor may also look inside the abdomen with a special tool called a peritoneoscope. If fluid has collected in your abdomen, your doctor may drain the fluid out of your body by putting a needle into your abdomen and using gentle suction to remove the fluid.

Thoracoscopy
The doctor may look inside the chest cavity with a special instrument called a thoracoscope. If fluid has collected in your chest, your doctor may drain the fluid out of your body by putting a needle into your chest and using gentle suction to remove the fluid.

The main cause of mesothelioma is exposure to fine fibers of asbestos. The higher rate of exposure to fine fibers of asbestos and the longer you are exposed increases the risk of developing mesothelioma. Sometimes the fibers enter the body through the lungs by an unsuspecting individual just breathing air containing asbestos fibers.Mesothelioma is almost always caused by exposure to asbestos. This can cause direct damage to the lungs by traveling to their small passages and reaching the of lungs.

Its takes a long time to develop inside a body it is difficult to identify the symptoms. Most people present with complaints of shortness of breath and also complaint the chest pain. These symptoms on their own will not identify the disease and are often misdiagnosed as asthma or other respiratory problems like pneumonia. As the disease progresses, shortness of breath increases, and weight loss, decreased appetite, and night sweats can develop. Local invasion by the tumor can result in changing of voice, loss of function of the diaphragm, and symptoms specific to the area and involvement of adjacent structures.

Mesothelioma is a form of cancer that develops in the tissues of cells that line the lungs, heart and stomach. Pleural mesothelioma is the most common form, often presenting with symptoms in the chest area. Peritoneal mesothelioma is much less common. These tissues are called mesothelial cells and they become infected by inhaling particles of dust from asbestos fibers. Once these cells become infected they dry up the fluids surrounding these major organs of the body and tumors begin to develop.

This can effect the organs in the abdomen, and its symptoms are related to this area of the body, that is, abdominal swelling, nausea, vomiting, and bowel obstruction. The rarest form of mesothelioma is pericardial mesothelioma, which involves surrounding the heart. The best way to approach dealing with mesothelioma is to first learn everything that you can about the disease. This should include the causes, symptoms, diagnosis, treatment, and prognosis of mesothelioma.
